General Terms and Conditions (hereinafter referred to as "GTCs") for the use of the games offered on the Casino Zürichsee AG Gambling Platform.

 

1. Scope of Application

1.1
Casino Zürichsee AG, based in Freienbach SZ (hereinafter referred to as "swisscasinos"), which is part of the Swiss Casinos Group, operates the website www.swisscasinos.ch as well as a native app (hereinafter referred to individually and collectively as the "Gambling Platform"). All rights and obligations arising from the use of the Gambling Platform are exclusively vested in swisscasinos.

swisscasinos is supervised by the Swiss Federal Gaming Board (SFGB) and holds extension license no. 2023-B-17-E for the operation of online games.

1.3
The GTCs govern the use of all games provided by swisscasinos on the Gambling Platform (hereinafter referred to as "game offerings"). Every player has the opportunity to win money or other cash equivalent on the Gambling Platform in return for wagering money.

1.4
These GTCs do not apply to the use of various Internet-enabled devices (PCs, tablets, mobile phones, etc.) or to third-party software for displaying and reproducing content from the Gambling Platform (operating system, browser, Adobe Flash player, Java, etc.). The use of these devices and software does not affect the legal relationship between swisscasinos and the player; their use is only subject to the GTCs of the relevant third-party providers.

The player accepts these GTCs by expressly agreeing to them during the registration process via the designated checkbox ("Agree to GTCs").

The latest version of the GTCs can be viewed, printed and saved to a local storage device at any time on the website www.swisscasinos.ch.

1.7
swisscasinos reserves the right to modify the GTCs at any time and at its sole discretion. swisscasinos will inform the player of any changes to the GTCs in an appropriate form before they take effect. If a player does not agree to the amendment of the GTCs, he/she must notify Customer Support in writing prior to the amendment coming into effect at Casino Zürichsee AG, Online Casino, Seedammstrasse 3, 8808 Pfäffikon SZ or at support@swisscasinos.ch. Failure to accept the updated GTCs will result in the closure of the player's account. If notice is given after the new GTCs have come into effect, the new GTCs will apply until the player's notice is received.

 

2. Registration

2.1
In order to use the services of the Gambling Platform, a player account must be opened. For swisscasinos to open the player's account, the player must properly register on the Gambling Platform.

2.2
The following player details are required for registration:
- First name and last name
- Date of birth
- Nationality
- Address of residence or domicile in Switzerland
- Valid email addres
- Phone number
- Username and password
- A payout account registered in the player's name

2.3
The username should not allow conclusions about the player's identity, as it will be visible to third parties. If a player chooses a username that discloses their identity, swisscasinos bears no responsibility for any unauthorized use of this information by third parties (e.g., other players).

2.4
By registering, the player declares that the funds used for deposits into their player account do not originate from illegal sources.

2.5
The player is responsible for securely storing their login details (username and password). Sharing these details with third parties is strictly prohibited.

2.6
Following registration, the player can only modify their domicile or residential address and phone number directly within their player profile. Any other personal information changes must be requested via written notification to Casino Zürichsee AG, Online Casino, Seedammstrasse 3, 8808 Pfäffikon SZ, via email to support@swisscasinos.ch, or through the Customer Support chat function.

 

3. Provisional Account Opening

3.1
After registration, swisscasinos may provisionally open a player account if it verifies that the requirements for account opening as per Section 3.2 are met and there are no indications that the provided details are incorrect.

3.2
To be eligible for provisional account opening, the player must:
- Be of legal age.
- Have a domicile or habitual residence in Switzerland
- Not be subject to a gambling suspension.
- Not be subject to a gambling ban.

3.3
The player is obliged to provide the personal details set out in Sections 2.2 and 3.2 truthfully and in a manner that is verifiable by swisscasinos.

3.4
The player must inform swisscasinos immediately of any changes to their registered email address and must inform swisscasinos of any changes to his/her personal details as set out in Sections 2.2 and 3.2 for the entire duration of the contractual relationship with swisscasinos.

3.5
swisscasinos may refuse the opening of a provisional player account without explanation or reason.

3.6
Upon provisional account opening, a gambling contract is established between the player and swisscasinos.

3.7
Until the account is definitively opened, deposits are limited to CHF 1,000 and winnings cannot be withdrawn.

 

4. Definitive opening of a player account

4.1
Before a player account is definitively opened, swisscasinos verifies the player's details in accordance with Sections 2.2 and 3.2 and confirms the player's identity within one month of the provisional account opening.

4.2
swisscasinos shall determine at its own discretion which documents are sufficient for the verification of the information provided in accordance with Sections 2.2 and 3.2. swisscasinos may at any time demand proof of the personal details and residential address (e.g. a copy of an official form of identification, a copy of the proof of domicile or residence which must not be older than three (3) months, or other documents that provide information about the player's actual place of residence or habitual domicile)

4.3
Proof of identity can be provided with (i) a copy of an official identification document (ID, passport, driver’s license), (ii) an electronic proof of identity (E-ID) or (iii) any other equivalent identification document recognised by the supervisory authority.

4.4
swisscasinos will definitively open the player’s account if (i) it has been possible to verify that the information provided by the player corresponds to the facts, (ii) it has been ensured that only one player account per person has been opened, and if (iii) the requirements set out in Section 3.2 are met.

4.5
swisscasinos may refuse definitive account opening without providing reasons.

4.6
If, after provisional account opening, swisscasinos determines that the provided details are incorrect, the individual already holds an account, or the conditions under Section 3.2 are not met, any positive balance will be transferred to the designated payout account in the player’s name. The maximum transferable amount is the total deposits made by the player. Any excess funds will be transferred to the Swiss social security fund (AHV-Ausgleichsfonds).

4.7
If swisscasinos determines, during the verification process under Section 3.2, that false information has been provided, it may charge the player for related administrative costs. The amount will be determined at swisscasinos sole discretion, taking into account the specific circumstances.

4.8
Personal details must be kept up to date. Any updates to information that cannot be modified directly in the player profile must be reported either in writing to Casino Zürichsee AG, Online Casino, Seedammstrasse 3, 8808 Pfäffikon SZ, or by email to support@swisscasinos.ch. swisscasinos will check the player's domicile or residence address each time a change is made.

4.9
swisscasinos is entitled to use player profile data for essential notifications, including but not limited to updates to the GTCs, password resets, and payout account inquiries.

 

5. Non-Transferability of Player Accounts

5.1
Each player account is personal and non-transferable. The player may only use the game offerings on the Gambling Platform in their own name. The use of the platform for purposes other than private entertainment, including commercial or professional purposes, is strictly prohibited.

5.2
In the event of a breach of Section 5.1 above, swisscasinos is entitled to refuse to payout any winnings and reclaim previously paid-out winnings.

 

6. Swiss Casinos Member Club

6.1
Upon definitive account opening, the player automatically becomes a member of the Swiss Casinos Member Club of the Swiss Casinos Group. Membership does not impose any obligations on the player. It grants simplified access to the physical casinos of the Swiss Casinos Group and entitles members to special discounts at their restaurants and bars.

6.2
Membership in the Swiss Casinos Member Club can be terminated at any time without stating reasons and without observing a notice period.

6.3
The General Terms and Conditions of the Swiss Casinos Member Club are available at www.swisscasino.ch.

 

7. Deposits and Payouts

7.1
The player account is funded by the player's deposits, winnings and any bonus credits granted by swisscasinos. The player's stakes placed when using the offer on the Gambling Platform are debited from the player account.

7.2
swisscasinos may, at its discretion, request information or evidence regarding the origin of the player's funds.

7.3
The player account is held in Swiss francs (CHF). The deposit amount is at least CHF 10.-. The player account cannot have a negative balance at any time.

7.4
Winnings in an online game are invalid if the requirements of Section 3.2 are not met and/or if the winnings were:
- Achieved as a result of malfunctions and/or errors in the player's hardware, swisscasinos or its game suppliers and/or software and/or on the Gambling Platform.
- Obtained through fraudulent or otherwise unlawful influence within the meaning of Section 9.4.
- Secured in violation of these GTCs.
- Scored in violation of one or more of the applicable gambling rules as defined in Sections 9 et seq. or in violation of the rules applicable in a specific game.
- Earned by manipulating bonus credits as outlined in Section 8.5.
- Won in a game subsequently deemed unauthorised by the SFGB.


Winnings will also be invalid if there is reasonable suspicion that,
- more than one player account belongs to the same person
- the player has used the technical support provided by swisscasinos or information obtained through it to cheat and/or influence the game offerings on the Gambling Platform.
- the player attempts to reverse engineer or decompile game offerings, alters, removes or makes unrecognisable the game logos, copies the games by any means or attempts to derive the source code of the games or other confidential information, pursues dishonest aims and takes other measures that could adversely affect the reputation, image or good name of swisscasinos or the game suppliers of swisscasinos.
- the player uses the Gambling Platform improperly, attempts to influence the proper gameplay, e.g. by using bots or other malware, or otherwise exploits a bug in the game.

7.5
swisscasinos reserves the right to withhold payout of invalid winnings as defined in Section 7.4 and to return only the original stake to the player. Any excess winnings will be transferred to the Swiss social security fund (AHV-Ausgleichsfonds). If an invalid win has already been credited to the player account, swisscasinos may deduct it. If this results in a negative balance, the player must cover the deficit.

7.6
Players who are underage, banned from gambling, or subject to a gambling suspension are not entitled to claim any winnings or refunds.

7.7
Winnings will be checked for validity within ten (10) days and credited to the player account if all requirements are met.

7.8
The player has the right to request the transfer of the active balance from the player account to the payout account at any time. This does not apply to bonus credits granted by swisscasinos. For this purpose, the player must provide swisscasinos with all necessary information regarding the payout account.

7.9
swisscasinos will only pay out the balance on the player’s account exclusively to a payout account in the name of the player account holder. The balance is generally paid out within five (5) working days. swisscasinos reserves the right to deduct any reasonable costs or expenses incurred in connection with a payout from the player’s account balance before processing the transaction. In particular, bank charges and reasonable compensation for swisscasinos' efforts will be charged to the player.

7.10
If a player believes that a win was not credited to their account, they must notify swisscasinos in writing, including an account history statement, within ten (10) days via email to support@swisscasinos.ch or by post to Casino Zürichsee AG, Online Casino, Seedammstrasse 3, 8808 Pfäffikon SZ.

8. Bonus Credits

8.1
Bonus credits are amounts of money that may be credited to a player's account in connection with promotions. The rules for specific bonus credits are described on the swisscasinos website at the time they are granted or in the context of the Games. Bonus credits can be used as stakes in the game offerings provided for this purpose.

8.2
All bonus offers (including free spins) are voluntary promotions and are not designed to strategically maximise winnings. swisscasinos reserves the right to temporarily or permanently exclude certain players from the bonus programme or restrict their participation at its own discretion. There is no entitlement to get or use a bonus offer.

8.3
swisscasinos reserves the right to modify, suspend, or discontinue any promotional offers at its descretion. The player will be informed accordingly.

8.4
All promotional offers are limited to one per person. If swisscasinos has reasonable grounds to suspect that a bonus has been claimed multiple times by the same individual or group, it reserves the right to void the bonus offer, cancel associated bets, revoke any winnings obtained using the bonus.

8.5
The manipulation or abuse of bonus credits is prohibited. Violations may result in account closure, the cancellation of winnings from bonus credits, and the recovery of paid-out funds.

8.6
Manipulation or abuse of bonus credit is considered to be among other things
- pursuing marginal or low-risk betting strategies such as in roulette by staking on red and black at the same time, even/odd bets, hedging all numbers, etc.
- pursuing special gambling strategies on the slots, such as when bonus credit is used to unlock "scatter wins" or bonus features and these are only activated after the bonus offer has been fulfilled or cancelled in order to have the winnings paid out in real money.
- increasing the game credit and then strategically changing the gambling behaviour (bet, type of game, bet structure, etc.) in order to meet the wagering requirements for a payout of the bonus credit in real money. This would be the case, for example, if the player bets the entire amount deposited and the bonus credit on one or more numbers in roulette and, in the event of a win, only plays slots in order to fulfil the wagering requirements.

 

 9. Game Rules

9.1
Before a game can be started, the player account must be opened, and it must have sufficient funds. It is the player's responsibility to familiarise themselves with the rules of a game. Instructions on how to play are available in the individual game offerings. For further information please contact swisscasinos customer support.

9.2
If a connection is lost during an ongoing game, the game progress will be saved on the servers. The player can view the result in their account, and any winnings will be credited accordingly. No additional stakes will be deducted, and the game will not continue automatically.

9.3
No content of an advertising, political, religious, insulting, defamatory, harassing, threatening, violent, racist, sexist, pornographic or otherwise morally reprehensible, immoral or offensive nature may be disseminated in connection with the use of the Gambling Platform.

9.4
Any form of fraudulent or otherwise unlawful behaviour in connection with the use of the Gambling Platform is prohibited. This includes in particular all actions that influence the course of the game, the security or transparency of the game or in any way serve to increase the chances of winning. This includes, for example, the use of computers, hardware and/or software or other automated processes and collusion with other players.

9.5
By using the Gambling Platform, the player agrees to receive communications from swisscasinos. However, the player can modify notification preferences in their account settings, except for essential communications regarding account security, gambling suspensions, or GTCs updates.

 

10. Self-exclusion from gambling and gambling suspension

10.1
Players can voluntarily exclude themselves from gambling for a period between 24 hours and six (6) months. The exclusion is lifted automatically after the selected period. Early re-entry is only possible upon application to swisscasinos.

10.2
Players may also request a permanent self-exclusion from gambling at any time. swisscasinos may also impose a gambling suspension against the player's will:
- if it knows or must assume based on its own observations or reports from third parties, that the player is over-indebted, fails to meet his financial obligations or places bets that are disproportionate to his income and assets.
- if it is known or presumed based on a report from a specialist centre or social welfare authority, that the player is addicted to gambling.
- if there are reasonable grounds to suspect that the player is involved in money laundering, terrorist financing or similar activities, or that the funds deposited are of criminal origin or originate from a criminal organisation.

10.3
swisscasinos will inform the law enforcement authorities and/or file a report with the Money Laundering Reporting Office if necessary.

10.4
swisscasinos shall notify the person concerned of the gambling suspension in writing, stating the reasons. The gambling suspension applies to all land-based casinos in Switzerland and the Principality of Liechtenstein, to all online gambling services licensed in Switzerland, to major online gambling events (including lotteries and sports betting) and to major gambling events to which the intercantonal authority has extended the gambling suspension in accordance with Art. 80 para. 3 of the Federal Gambling Act.

10.5
swisscasinos maintains a register of gambling bans. The register contains the first name and surname of the banned person, date of birth, nationality, type and reason for the suspension imposed, and the date of the suspension. swisscasinos shares the contents of the corresponding register with the other casinos and organisers of major games, which in turn grant swisscasinos access to the registers they maintain.

10.6
The gambling suspension imposed by swisscasinos will be lifted upon the request of the affected person if the reason for the suspension no longer applies. A cantonally recognized specialist or specialized institution will be involved in the lifting procedure. In the written request for the suspension to be lifted, the player agrees to grant the specialist or institution access to the necessary data required for the review of the suspension’s removal. A voluntary gambling suspension can only be lifted upon the player’s request and no earlier than three (3) months after the suspension has begun.

 

11. Additional Measures to Prevent Excessive Gambling

11.1
The player can access their account at any time to review information about their gambling activity, including bets placed, winnings, and net gambling results. Additionally, the account provides a self-assessment test for evaluating gambling behavior, guidance on how to request a gambling suspension, contact details of swisscasinos responsible gambling officer, and information on gambling addiction support services.

11.2
The player must set one or more limits on potential daily, weekly, or monthly losses. Limits can be adjusted freely at any time; a reduction takes effect immediately, while an increase takes effect no sooner than twenty-four (24) hours later.

11.3
The player may set additional limits to control their gambling behavior, including deposit limits, game breaks (temporary gambling suspension), and session duration limits (i.e., the length of time connected to swisscasinos server). Similar to Section 11.2, reducing protection measures (e.g., increasing deposit limits, reducing game breaks, extending session duration) takes effect no sooner than twenty-four (24) hours later.

 

12. Account Closure

12.1
The player may request the closure of their player account at any time by submitting a written request to Casino Zürichsee AG, Online Casino, Seedammstrasse 3, 8808 Pfäffikon SZ, or via email at support@swisscasinos.ch.

12.2
Each person may only have one player account. If there is suspicion that a player holds multiple accounts, swisscasinos reserves the right to block all related accounts until the necessary verification is completed. If the suspicion is confirmed, all accounts will be closed.

12.3
swisscasinos may also close the player’s account against the will of the person concerned:
- If the requirements under Section 3.2 are not (or are no longer) met.
- If a player account has remained inactive for more than two years, whereby the reason for the inactivity may also be a gambling suspension.
- If there are reasonable grounds to suspect that the player is using the technical support provided by swisscasinos or information obtained through it to cheat and/or influence the game offerings on the Gambling Platform.
- If there is reasonable suspicion that the player is attempting to reverse engineer or decompile games, alter, remove or obscure the game logos, copy the games by any means or attempt to derive the source code of the games or other confidential information, pursue unfair purposes with the games or take other measures that could adversely affect the reputation, image or good name of swisscasinos or the game suppliers of swisscasinos
- If the player violates these GTCs or the applicable gambling rules.
- If there are reasonable grounds to suspect that the player is using the Gambling Platform improperly, attempting to influence the proper gameplay, e.g. by using bots or other malware, or otherwise exploiting a bug in the game.
- In all other cases that make it unreasonable for swisscasinos to continue the player account, whereby this decision is at the discretion of swisscasinos.

12.4
Account closure terminates the contractual relationship between the player and swisscasinos. swisscasinos will notify the player in advance of the account closure and outline the consequences. Following account closure, the player is strictly prohibited from opening a new account under a different identity.

12.5
If the player's payout account details are no longer valid and swisscasinos is unable to contact the player despite reasonable efforts, swisscasinos will hold the remaining balance in the closed account for two years. After two years, any unclaimed funds will be transferred to the Swiss social security fund (AHV-Ausgleichsfonds).

 

13. Terms of Participation for Competitions

13.1
By participating in competitions, the player accepts the following conditions.

13.2
All natural persons aged eighteen (18) or older with permanent residence in Switzerland who are not subject to a gambling ban or suspension are eligible to participate. Employees of swisscasinos are excluded.

13.3
Only one entry per person is allowed. Participation requires that all required information be provided completely, accurately, and truthfully. Automatically generated entries, bulk submissions, and technical manipulations are prohibited. Participation is free of charge. The deadline for entries is specified on the competition page.

13.4
Winners are determined by random draw and notified in writing. Cash payouts, substitutions, or exchanges of prizes are not permitted.

13.5
swisscasinos may interrupt or cancel a competition at any time for valid reasons. No compensation claims shall arise from such interruptions. Valid reasons include technical or legal issues that prevent the competition from being conducted properly.

13.6
To the extent permitted by law, swisscasinos excludes all liability in connection with competitions

13.7
No correspondence will be entered into. There is no right of appeal. Competitions held on Facebook or Instagram are not connected to Meta Platforms. Meta Platforms is not the organiser, sponsor or supporter of swisscasinos. swisscasinos is the sole organiser of the competition and the sole point of contact and is solely responsible for the competition.

 

14. Data Protection

14.1
swisscasinos processes personal data in accordance with the Swiss Federal Act on Data Protection (FADP).

14.2
The swisscasinos privacy policy on the use of the Gambling Platform (available at: https://www.swisscasinos.ch/datenschutzerklaerung) forms an integral part of these GTCs. The privacy policy provides detailed information on how swisscasinos collects, processes, and protects personal data.

 

15. Intellectual Property

15.1
The Gambling Platform and all content and game offerings available on it are protected by copyright. Unless otherwise stated, swisscasinos owns the Gambling Platform, domain, and all related content. Any use of platform content for private, public, or commercial purposes is prohibited without prior written consent from swisscasinos and/or listed third-party providers.

 

16. Warranty and Liability

16.1
swisscasinos provides all services related to the operation of the Gambling Platform with care and professionalism. However, swisscasinos may be prevented from maintaining uninterrupted operation due to external factors beyond its control. These include technical disruptions, IT failures, and software-related errors.

16.2
swisscasinos does not guarantee uninterrupted availability or error-free functionality of the Gambling Platform. The same applies to third-party attacks on its systems. swisscasinos may restrict access to the platform at any time, either temporarily or permanently.

16.3
swisscasinos shall only be liable for damages that it has directly caused to the player through gross negligence and/or intent, provided that the relevant behaviour was within its area of responsibility. Any further liability of swisscasinos is excluded to the extent permitted by law. This applies in particular to damages suffered by the player which are attributable to slight or moderate negligence on the part of swisscasinos.

16.4
swisscasinos therefore accepts no liability for malfunctions and damage to the Gambling Platform resulting from technical faults or other interventions by third parties, or for damage to the player resulting from the unauthorised use of access data and the player account by third parties or from the player losing his or her password, giving it to third parties or otherwise disclosing it. Furthermore, swisscasinos accepts no liability for the content of third-party websites to which the swisscasinos Gambling Platform refers or which refer to the swisscasinos Gambling Platform.

16.5
swisscasinos is not liable to the player, either contractually or non-contractually, for losses of any kind or for the loss of data, including the player's personal data, incurred by the player in connection with the use of the Gambling Platform.

16.6
By using the platform, the player expressly agrees to indemnify and hold harmless swisscasinos, its affiliated companies, executives, agents, and employees from any liability or damages arising from violations of these GTCs or unauthorized use of the Gambling Platform or player account.

 

17. Severability Clause

17.1
In the event that specific provisions of these GTCs are invalid or incomplete or fulfilling them becomes impossible, the validity of the rest of the provisions in this agreement will not be affected.

17.2
The invalid or unenforceable provision shall be replaced by a legally valid provision that most closely reflects the original intent. The same principle applies in the case of contractual gaps.

 

 

18. Applicable Law and Jurisdiction

18.1
The legal relationship between the player and swisscasinos.ch is governed by Swiss substantive law.

18.2
The place of jurisdiction for all existing and future legal disputes arising from or connected with this legal relationship is Freienbach, Switzerland.

 

 

19. Precedence of the German Version

19.1
In the event of any disputes arising from or in connection with these GTCs, particularly regarding their interpretation, only the German version shall be authoritative. Translations are provided for informational purposes only.
